The Platform
- Welcome to shortstayhomes.ng subscription Platform www.shortstayhomes.ng (‘Platform’). The shortstayhomes.ng Platform is a product of and provided by Shortstayhomes NG, Shortlet Apartment owners, managers and reservation officers.
- These Terms and Conditions (‘Terms’) are Shortststayhomes NG (‘shortstayhomes NG’ ‘us’, ‘we’, or ‘our’) and a user who accesses or subscribes to the Platform (‘Guest’, ‘you’ or ‘your’). These Terms outline the terms and conditions of our relationship with you, as supplemented by our Privacy Policy. By using or subscribing to the Platform, you agree to be bound by the following terms and all applicable laws and regulations. These Terms and any relevant specific terms govern your use and access to the Platform.
- Shortstayhomes.ng reserves the right to modify these Terms at any time in at its sole discretion. You are encouraged to review the most current terms and any relevant specific terms each time you visit the Platform. Your continued use of the Platform after such changes are implemented constitutes your acknowledgment and acceptance of the changes. If you do not wish to be bound by these terms, do not use or access the Platform or use our Services.
- Your use or access of the Platform in any way signifies your constructive and actual notice and knowledge of, and your agreement to be bound by, the most current version of the Terms as posted on the Platform and our Privacy Policy. It is solely your responsibility to ensure that your use of any and all third-party Platform or content is in compliance with any and all third-party requirements.
Eligibility to use the Platform
- In order to use or access the Platform or subscribe/register for our Services, you represent and warrant that you are at least 18 years of age and are legally able to enter into a binding contract.
- You authorize us, directly or through third parties, to make any inquiries we consider necessary to validate your identity.
User Representation
You represent, warrant and agree that no materials of any kind submitted through your Account or otherwise posted or shared by you through the Platform will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory, fraudulent or otherwise unlawful material. You further agree not to collect email addresses or other contact information of other users from the Platform by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. Additionally, you agree not to use automated scripts to collect information from the Platform or for any other purpose. You further agree that you may not use the Platform in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Platform
Account Registration and subscription fee
- To obtain full access to the Platform, you will be required to complete a registration process. You will be asked to:
- Provide certain registration details or other information; to establish your account on the Platform (‘Account’).
- You shall also be required to pay an annual subscription fee of One Hundred Thousand Naira Only (N100,000.00) or local currency equivalent and by signing up for your Account, you agree to pay the annual subscription fee.
- Shortstayhomes NG rates are dynamic due to seasonal, peak and off peak demands and as a result. Daily, weekly, monthly or yearly rates will always be announced and all verified hosts notified via SMS, email or WhatsApp group. You must pay Shortstayhomes NG the set daily rate at the time given by Shortstayhomes NG plus VAT (subject to availability and terms stated by Digital Landlords partners).
- You earn 2000 points for every successful bookings made and each friend you invite to the platform who subscribes successfully.
- When you earn a total of 60,000 points, you are entitled to a free night in any Shortstayhomes NG or you can sublet your free night keeping 100% of your rental income.
- You will receive a digital booking card customized for you and shareable with your contacts where all your bookings will be made and linked to your account.
- Subscription fees once paid are non-refundable as it covers admin and set up fees.
About our short let properties
- Our shortlet properties are furnished and equipped to high standards. From time to time, we may change the layout, furniture or fittings and we will try to update these on the Platform at the earliest opportunity and notify Guests if the changes to the properties change the nature of the accommodation.
- Differences between the description and photos on the Platform and those actually found at the property do not constitute a basis for cancellation, refunds or other claims against us. We will not be liable to Guests in the event of changes made to a property by us and not notified Guests. Internet connection is provided at our properties. There is no charge for normal use of this facility. If a loss of internet connection occurs, we will endeavour to get you reconnected as quickly as possible but we cannot be held liable for any losses resulting from the loss of internet connection.
- Unless otherwise specified, the prices quoted for all serviced properties include utilities.
Bookings and Rates
- A booking is not confirmed until you receive a confirmation from us. A pre-payment of 60% of the rental price is payable on booking and confirmation will not be effected until the whole of the pre-payment has been received. The balance of the rental price must be paid 48hrs before check-in; non-payment of the balance by the due date will constitute a basis for canceling your booking and the application of the cancellation policy with no refund if cancellation made outside of cancellation terms stated in this agreement.
- The minimum number of days acceptable for booking per time is 1 night during off peak periods and 3 days during peak periods i.e. A minimum of 3 nights stay per time is required to confirm a booking subject to availability of dates.
The Ten Golden Rules
- Maximum number of people allowed in the apartment for accommodation purpose only is Two (2) to Twelve (12) depending on the apartment size.
- A caution deposit of N30,000 toN100,000 f is payable for accommodation and a minimum of N100,000 for photoshoot, get-together or any commercial. This refundable fee must be paid in full before check-in date or upon arrival
- Smoking is NOT allowed in all of our properties
- No Drugs or weeds are allowed in all our properties. Any guest found flouting this rule shall be ejected from our properties without recourse to refunds
- Cigarette burnt attracts a fine of N300,000.00 only
- Stay safe, sanitize and dis-infect. To achieve this, we have provided hand sanitizers at the entrance of all our apartments. We observe all Airbnb cleaning rules. On the other hand, guests are expected to stay safe by sanitizing their hands as frequently as possible, minimize the number of guests in the house to the maximum allowable and wear a mask each time they go out
- For a get-together, the maximum number of guest allowed in the apartment is Ten (10) to Thirty (30) depending on the apartment size Please note that PARTIES ARE NOT ALLOWED IN OUR APARTMENTS.
- Get-together warrants a caution fee deposit of N100,000 and N150,000 for deep cleaning. Where damages occur, guest may be charged as high as N500,000. All these charges are avoidable if guest obey the house rules
- Guests and their visitors are expected to respect the other residents in the estate as they have the right to terminate the tenancy of any erring guest. Violence is not an option, it will not be tolerated
- NO LOUD MUSIC. It attracts a fine of N100,000 and the tenancy can be terminated expressly without recourse to a refund
RESERVATION POLICY
- For any reservation to be valid, reservation can only be held for 48hours; after which it is cancelled automatically
- A deposit of 50% of the total accommodation bill shall be required to make a valid reservation
CANCELLATION POLICY
- Cancellation made fourteen (14) days before arrival date attracts no charge
- Cancellation made less than 14 days before arrival date attracts 30% of full booking fee
CHANGE OF DATE POLICY
This attracts a penalty of 10% of full booking fee
REFUND POLICY
- Host commission shall be paid on the last day of every month
- Guest’s caution deposit refund shall be paid within 72hours of check out
Cancellation and change of booking date
- Any cancellation or modification of a booking can only be effected by the Guest providing a written notification of the cancellation or modification to Shortstayhomes NG. The non-payment of rental balances results in automatic cancellation.
- Should the Guest for whatever reason cancel the booking, they will have the right to reimbursement of all money paid subject to the deduction of cancellation charges being 30% of the total rental price if cancellation is made 14 days prior to the guest checking in. You earn 20% commission from cancellation fees made 14 days prior to the guest checking in.
- Changes to booking dates or properties are subject to availability. Each booking change shall incur a service fee of 10% to be paid at the time of confirming the said changes of which you split equally with Shortstayhomes NG.
- If we cancel a confirmed booking, we shall do our utmost to find a replacement property acceptable to the Guest, or refund any monies paid on unused rental. The Guest agrees and acknowledges that in this event, Shortstayhomes NG' liability for damages will be limited to the amount of unused rental, based on a pro rata calculation of unused rental days.
- Should a property become unserviceable prior to the arrival of a Guest, We will do our best to find a suitable replacement property of an equal standard. In the event of a more expensive property being selected, the Guest will have the choice of paying the difference or receiving a full refund of monies paid.
- The rules for check-in and check-out are set by us. All properties are usually available for occupation after 12:00 noon on the day of arrival. All properties must be vacated by 12:00 noon on the day of departure. If there is any delay in vacating the property beyond the agreed time a full day’s rental is charged to you.
Security Deposit and Property Damage
- A refundable security deposit of ₦30,000.00 to ₦100,000.00 shall be required by Shortstayhomes NG prior to or on arrival of the Guest provided the booking is for accommodation purposes only and not for get-togethers, photoshoots, video shoots or bookings requiring more than 6 guests/people and no more than 12 guests / people at a selected Shortstayhomes NG properties.
- Get-togethers, photoshoots, video shoots or bookings requiring more than 6 guests / people and no more than 12guests / people at a selected Shortstayhomes NG properties will warrant a ₦100,000.00 refundable caution fee and ₦150,000.00 deep cleaning refundable fee payable before check-in at a daily rate of ₦130,000,00 – ₦160,500.00 per night depending on location of property
- All security deposits are fully refundable PROVIDED there are no damages to the booked Shortlethomes property by your chosen guest.
- Cancellations cannot be made once the guest has checked-in and all booking payments are non- refundable after the guest has checked-in.
- In the event that a guest damages an item, multiple items or damage the property, a guest forfeits the caution or security deposit paid and the guest is liable to cover cost of up to ₦500,000 damages equating to the cost of replacing the damaged item(s) or damaged property as stipulated by Shortlethomes.
- The security deposit shall be refunded within 72hrs of you or your guest’s departure.
- We have the authority to withhold or deduct monies from the security deposit or credit card to remedy any damage, excess cleaning, missing items, excess utilities caused by the Guest or to send an invoice for such monies to the Guest by email for immediate payment.
- You may not remove any of the furniture or effects from the properties and will be liable for any furniture or effects damaged or missing from the properties. Furniture must be returned to its original position.
- Our representatives and subcontractors have the right of access to the property at any time, with due regard to your convenience, for the purpose of inspection of the properties and to carry out any essential repair or maintenance work.
Conduct of Guests
- All accommodation must only be used for private/residential use only. The maximum number of guests allowed Two (2) to Twelve (12) depending on the size of the apartment.
- No functions, get-togethers or gatherings where occupants of neighbouring apartments might be disturbed may be conducted at the property under any circumstances unless agreed by Shortstayhomes NG in writing before you or your guest checks in. Exceeding the number of allowed guests will result in automatic termination of booking and you being required to vacate the property immediately without refund unless already agreed in writing by Shortstayhomes NG.
- There is no smoking inside any of our properties. If there is evidence of such including a smoke odour, you will be charged a fee of ₦300,000.00 to cover the cleaning of curtains and carpets and to replace items with cigarette burns.
- You must leave our properties in a clean and tidy condition. You must also comply with the By-Laws that apply to the properties and shall not be guilty of conduct which is a nuisance or annoyance to adjoining or neighbouring occupiers. In the event that the property requires deep cleaning as a result of your stay, you will be charged an additional ₦150,000.00 and you forfeit your deposit.
- No pets are allowed inside the accommodation under any circumstances. Any pets found inside the properties will result in a termination of your booking without refund.
- We have the right to terminate a booking at any time on the grounds of breaking the agreement within these terms or the abuse of these terms including being a nuisance to staff, residents or other guests, mistreatment of the property or criminal activity on the part of those occupying the apartment or their guests. No refunds are made in the event of this happening.
Suspension of the Platform
We do not guarantee that our Platform will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Platform for business and operational reasons.
Disclaimers
We do not promise that the Platform or any content, service or feature of the Platform will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the Platform will provide specific results. The Platform and its content are delivered on an "as-is" and "as- available" basis. All information provided on the Platform is subject to change without notice. We cannot ensure that any files or other data downloaded from the Platform will be free of bugs or viruses. We disclaim all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. We disclaim any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Platform. You assume total responsibility for your use of the Platform.
Limitation of Liability
- Under no circumstances shall we be liable to you for any indirect, consequential, exemplary, incidental or punitive loss or damages arising from your direct or indirect use of the Platform.
- Guests acknowledge that they are responsible for taking all necessary safety precautions for themselves and their guests and neither Shortstayhomes NG accept any liability for accidents causing death, sickness or bodily harm howsoever caused. Shortstayhomes NG deny any liability or claims in the event of incidents occurring whilst occupants or guests are under the influence of alcohol or drugs. The limitation of liability for any claim against us is limited to the total amount of rental paid to us by the Guest.
- We will not be liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or canceled or we are unable to perform our contractual obligations as a result of events beyond our reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, and adverse weather conditions
Waiver and Severability
Our failure to enforce a provision of these terms is not a waiver of our right to do so later. If any provision of these terms is found invalid or unenforceable by any court of law, the invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions of the terms, which will remain in full effect and an enforceable term or terms will be substituted reflecting our intent as closely as possible. No waiver of any of these terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
Governing Law
All matters or disputes relating to your access to or use of the Platform, or arising from the booking of accommodation with us, will be governed by the laws of The Federal Republic of Nigeria and the Nigerian Courts shall have exclusive jurisdiction to determine such disputes or matters.
